Please read these conditions carefully before using our services. By using Happykoala.org services, you signify your agreement to be bound by these conditions.

These terms and conditions will prevail over any other document. They are applicable in France. By clicking the box; the buyer not only agrees with these Terms and Conditions, he also acknowledges having read, at the time of ordering, the special conditions that may apply to each product specifically.

The buyer accepts his responsibility for his purchase. In the event of international purchases, the buyer assumes the responsibility for any special legal requirement or limitation to the import of the product in his/her country. Being the buyer considered as importer, he must comply with all laws and regulations of the country where the products are received. For this information; buyer will check with local customs office for detailed information. The customer privacy is really important to us, but international buyers must be that cross-border deliveries are subject to opening and inspection by customs authorities.

1. PRODUCTS

The images of the products on our site are for illustrative purposes only. Although we make every effort to display the colours accurately; we cannot guarantee that the buyer’s computer display the colours accurately. Also our products may vary slightly from those images.

The packaging of the Products may vary from that shown on images on our site.

Happykoala.org updates the stock inventory regularly but in some instances an item may become unavailable between updates. Happykoala.org will inform the customer by e-mail as soon as possible if the ordered product is no longer available. If this happens Happykoala.org will dispatch the order as soon as the Products become available.

All promotions are subject to availability.

2. ORDER

The automatic registration systems are considered as proof of the nature, content and date of the order. Happykoala.org will confirm by email the acceptance of the order. The email is provided by the buyer at the moment of the purchase. The sale will be concluded only after email confirmation from by Happykoala.org.

Happykoala.org reserves the right to refuse any order from a buyer with an open file for payments in previous orders. Happykoala.org reserves the right to reject a customer purchase order if the product is temporarily out of stock. Happykoala.org may also refuse the purchase in the event of payments arrears or problems with the payment authorization. Any incident will be communicated by email to the email address indicated by the customer. The customer is obliged to provide correct data during registration and to keep this data up to date at all times. As the personal information is indicated by the Buyer, Happykoala.org will not be responsible for mistakes in provided delivery addresses.

Shipping fees are indicated in the Delivery page.

3. DELIVERY

Delivery will be made by post or by carrier.

Delivery will be made within 5-7 working days after receipt the payment to the address specified by the customer. The indicated delivery times are general time frames established by the shipping company. These time frames are on top of item availability times and order preparation times. No refund for shipping fees can be made on orders delivered later than the indicated delivery times. If the product is temporarily out of stock, Bewelleness.eu will inform the customer by email about the possible delay or cancelled orders.

In case of absence, the Purchaser will recover the package on the terms proposed by the deliverer.

No claims can be made for possible delays.

A delay up to 30 days is accepted in purchases made through internet. Beyond this delay purchaser will be entitled to a total refund through the same method used to pay the product. Customer will be entitled to choose between refund or purchase bonus for the same value of the purchased product.

When buying technical goods; Customer will pay special attention to the instructions provided, and will verify the proper operation of the device. In case of defects, customer will be entitled to return the item in accordance with the terms of the article 9 of our Terms and Conditions.

Customer will inspect the parcel upon reception.

During delivery of the order, it is important to check that the package has not been damaged during transport. This must be done in the presence of the deliveryman;

If the packaging of your package and/or the item(s) is/are damaged, Buyer must enter the details of the damage on the Shipper’s Delivery Slip. The buyer will can also refuse the delivery. The Shipper’s Delivery Slip will be an important document in case of compensation requests (refunds, exchanges) to Happykoala.org or the shipping company.

If the customer notices any damage after unpacking the package, he must contact Happykoala.org within the 72 hours following to the reception of the parcel.

For availability reasons; Happykoala.org may fulfill one single order through different deliveries. Buyer will pay just once for the delivery, no matters how many parcels Happykoala.org send for the same order.

If the buyer would like to send parts of an order to different delivery addresses then he will need to place separate orders. It is necessary an order per address.

In the event of force majeure Happykoala.org will be released of any obligation. We will consider force majeure: war, riots, fire, strikes, natural or non natural disasters, etc.

5. PRICES.

All the prices are expressed in Euros/British Pounds and US Dollars.

The prices of the Products will be as quoted on our site from time to time. We make every effort to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system. However if we discover an error in the price of Products you order we will inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.

The price of a Product does not include delivery charges.

The price of a Product does not include VAT. Final price will appear in the order confirmation.

The order confirmation includes the tax information and also the delivery charges (packing and postage). Buyer will acknowledge all charges before complete the final order.

6. PAYMENT.

Happykoala.org will email the final invoice to the customer. The invoice will include final price including taxes and delivery.

Payment for the Products and all applicable delivery charges are in advance. The order will be dispatched once the payment is confirmed.

We accept payment by PayPal.

Any payment must be confirmed for our data centre therefore the order will be considered effective once the data centre confirm the payment due.

In the event of rejected payment or not payment, the order will be cancelled.

Email notification will be sent to the customer.

As stated in our article 3, Happykoala.org reserves the right to refuse any order from a buyer with an open file for payments in previous orders.

7. WARRANTY

Our warrants cover faulty of damaged products. The customer will contact our customer services department via “contact form”.

Our customers are protected against hidden faults or defects (Civil Code- art 1625 and following articles).

Some of the Products we sell come with a manufacturer’s guarantee. For details of the applicable terms and conditions, please refer to the manufacturer’s guarantee provided with the Products.  It is important that the customer keeps any guarantee.

If a manufacturer’s guarantee applies, this will be in addition to any legal rights you may have in relation to the Products.

These warranties are exclusive of all other guarantees, notably guarantees of result relating to the satisfaction of the customer’s specific needs.

Happykoala.org will legally repair any consequences (Civil Code – art 1641 and following articles) resulting from a hidden defect. If the customer decides to sue Happykoala.org; this has to be made “promptly” after the discovery of the hidden defect (art 1648 – Civil Code). Customer may need to provide all the requested proofs of the hidden defect.

8. RETURN AND REFUNDS.

Our customers can order within the fourteen 14 return.
Working days of the plot reception (Hamon law).

Must return on our investment (address will be provided depending on your country) arrive in the saleable condition; Customers must ensure that the returned items are unopened and packed well to arrive undamaged.

To have a full refund or exchange of the product; the packaging arrive undamaged; contain including all accessories, invoice, manuals, documentation, and other items in the original package.

In the case of a refund; Happykoala.org is required to refund only the purchase price of the product.

Shipping costs are not included.

Reimbursement shall be made within a period of 15 working days at most.

9. PROMOTIONS, PROMOTIONAL CODES, AND VOUCHERS.

Coupon codes or voucher will not apply to discounted products.

The combination of different discounts or vouchers is not allowed in the same order.
